Allam Homes’ Rewards Program Terms & Conditions

1. Introduction

Allam Homes’ Rewards Program offers benefits to Rewards Members including:

• Repeat Purchase Rewards (refer to section 3); and

• Referral Rewards (refer to section 4).

2. Rewards Members

2.1 Who can be a Rewards Member

A Purchaser who has previously completed a Prior Eligible Contract can apply to become a Rewards Member.

2.2 How to apply

To apply to become a Rewards Member, the Purchaser must submit an online application form to Allam Homes, which is available at https://www.allam.com.au/refer... There is no fee payable to become or remain a Rewards Member. Upon joining the Rewards Program, the Purchaser is deemed to have accepted these Terms and Conditions and consents to receiving email and SMS communications from Allam Homes in relation to the Rewards Program.

2.3 Verification of eligibility

All application forms are subject to a verification process to be conducted by Allam Homes to determine eligibility, which may include:

(a) a verification of identity;

(b) evidence of completion of an Eligible Contract or Prior Completed Eligible Contract;

(d) any other verification process reasonably required by Allam Homes.

Verification is at the sole discretion of Allam Homes. Allam Homes is not required to accept any application that has not been fully or correctly completed, but may do so in its absolute discretion.

2.4 Excluded purchasers

The following Purchasers are not eligible to become a Rewards Member:

(a) Agents and their Immediate Family or any third-party who may be entitled to receive any remuneration for a sale under a Contract; and

(b) any person who is subject to a Commercial Transaction.

3. Repeat Purchase Reward

3.1 Overview

A Rewards Member is entitled to receive a Repeat Purchase Reward on completion of a subsequent Eligible Contract. For the avoidance of doubt, only one Repeat Purchase Reward is payable for each Eligible Contract.

3.2 What is the value of the Repeat Purchase Reward

A Rewards Member is entitled to a Repeat Purchase Reward on completion of each subsequent Eligible Contract as follows:

(a) [1.0%] of the value of the purchase price on the first (1st) subsequent Eligible Contract; and

(b) [1.5%] of the value of the purchase price on further subsequent Eligible Contracts.

3.3 How to apply for a Repeat Purchase Reward

A Rewards Member must complete an online application form, which is available at https://www.allam.com.au/refer..., prior to the Reservation.

3.4 Payment of Repeat Purchase Reward

The Repeat Purchase Reward will be applied as a discount off the purchase price at the time of Reservation. For the avoidance of doubt, there will be no further discount applied on completion of the Eligible Contract.

4. Referral Reward

4.1 Overview

A Rewards Member is entitled to a Member Referral Reward, and a New Purchaser is entitled to a New Purchase Referral Reward after the Rewards Member introduces the New Purchaser to Allam Homes in accordance with these Terms and Conditionsand where the New Purchaser completes an Eligible Contract.

4.2 What is the Referral Reward

The Referral Rewards comprise the following:

(a) a Rewards Member who refers a New Purchaser to Allam Homes, which New Purchaser completes an Eligible Contract, is entitled to a Member Referral Reward; and

(b) a New Purchaser who is referred by a Rewards Member, which New Purchaser completes an Eligible Contract, is entitled to a New Purchaser Referral Reward.

4.3 How to apply for a Referral Reward

A Rewards Member must complete an online Member Referral Application Form which is available at https://www.allam.com.au/refer... before the New Purchaser makes a Reservation.

4.4 Multiple New Purchasers

Where there are multiple New Purchasers named on an Eligible Contract, only one New Purchaser is entitled to receive a New Purchaser Referral Reward. For the avoidance of doubt, only one Member Referral Reward and one New Purchaser Reward is payable for each Eligible Contract.

4.5 Multiple Referrals

There is no limit to the number of Referral Rewards that a Rewards Member can earn for referring separate New Purchasers to Allam Homes, where those New Purchasers complete an Eligible Contract.

4.6 Payment of Referral Rewards

Referral Rewards will be sent by mail to each of the Rewards Member’s and New Purchaser’s nominated addresses within 60 Business Days following completion of the Eligible Contract by the New Purchaser. Referral Rewards cannot be transferred or exchanged and are not redeemable for cash.

5. Obligations

Rewards Members must not:

(a) act in any way that breaches these Terms and Conditions;

(b) abuse or misuse the Rewards Program;

(d) sell, assign, transfer or offer to sell, assign, transfer any Reward.

6. Privacy

All Personal Information collected by Allam Homes will be used in accordance with Allam Homes’ Privacy Policy. Rewards Members agree to provide Allam Homes accurate and complete Personal Information when making any application in connection with the Rewards Program. Allam Homes reserves its rights to reject any application it believes is incomplete, untruthful, or ineligible.

7. Anti-Spam

Rewards Members must not share, publish or forward any link containing any information in relation to the Rewards Program with any New Purchaser unless the Rewards Member believes that the New Purchaser is genuinely interested in entering into an Eligible Contract. Rewards Members indemnify and hold harmless Allam Homes, its directors, officers, employees, agents and successors, from and against any claims that may arise as a result of a Rewards Member failing to comply with this clause 7.

8. Cancellation

Rewards Members can cancel their Rewards Program membership at any time by sending an email request to marketing@allam.com.au.

9. General Conditions

9.1 Commencement

The Rewards Program is available during the Rewards Period.

9.2 Rewards Program Membership

Allam Homes reserves its rights, in its absolute discretion to:

(a) accept or refuse any application for a person to become a Rewards Member;

(b) suspend or terminate a Rewards Member’s participation in the Rewards Program; or

9.3 Variations

Allam Homes reserves its rights, in its absolute discretion, to cancel, substitute or vary in whole or in part the Rewards Program including cancelling, substituting, excluding or varying any Participating Development. Where Allam Homes cancels, varies, or substitutes the Rewards Program under this clause 9.3, Allam Homes agrees to use all reasonable endeavours to publish any notification on its Website which will be deemed to be sufficient notice.

9.4 Liability

To the extent permitted by law, Allam Homes (including its officers, employees and agents) is not liable for any cost, loss or damage incurred relating to:

(a) any withdrawal, cancellation, variation or change to the Rewards Program or these Terms and Conditions;

(b) any breach of these Terms and Conditions by any person other than Allam Homes; or

9.5 GST and Tax

Any tax, duty or liability whatsoever in relation to any Reward received under the Rewards Program will be the sole responsibility of the Rewards Member. Rewards Members should contact their accountant or taxation advisor if they have any queries relating to the tax implications of receiving any Reward.

9.6 Severability

If any part or parts of these Terms and Conditions are deemed unlawful or void or for any reason unenforceable then that provision may be severed from these Terms and Conditions and it will not affect the validity and enforceability of the remaining provisions.

9.7 Waiver

Any waiver by Allam Homes of its rights under these Terms and Conditions, shall not be deemed a waiver of any other term or provision and shall be limited to a single waiver limited to the specific circumstance under which such waiver was granted.

9.8 Governing Law

These Terms and Conditions are governed and are to be construed under the laws of New South Wales. Rewards Members agree to submit to the exclusive jurisdiction of the courts of New South Wales and any courts which may hear appeals from those courts in respect of any proceedings in connection with these Terms and Conditions.

10. Definitions and Interpretation

In these Terms and Conditions unless otherwise specified, the following rules of interpretation apply:

(a) a singular word includes plural and vice versa;

(b) if a word or phrase is defined, then any grammatical variation of that word or phrase has a corresponding meaning;

(c) use of the word ‘including’ does not limit the scope of that thing, but means ‘including without limitation’ or ‘including but not limited to’;

(d) a reference to $ means Australian dollars; and

(e) all references to dollar amounts exclude any applicable rate of GST.

In these Terms and Conditions, the following definitions apply:

Agent means a real estate or selling agent, its employees and/or contractors engaged by Allam Homes to sell or offer to sell property on behalf of Allam Homes, regardless of whether remuneration is by way of salary, wages, commission or otherwise.

Allam Homes means Allam Homes Pty Ltd ACN 003 798 883 of Level 3, 11-13 Brookhollow Avenue, Norwest or any of its associated or related entities.

Business Day means any that is not a Saturday, a Sunday, or a public holiday or bank holiday in Sydney, New South Wales.

Commercial Transaction means any transaction between a Purchaser and Allam Homes for the purchase of multiple lots within a Participating Development with the intention of the Purchaser on selling to third-parties.

Contract means any of the following contracts entered into with Allam Homes:

(a) a contract for the sale and purchase of vacant land;

(b) a contract for the sale and purchase of a house and land package; or

Eligible Contract means a Contract entered into during the Rewards Period for the purchase of vacant land, a house and land package, or a home (as appropriate) in a Participating Development for a purchase price of not less than $100,000.00, which Contract has been completed by a Purchaser who is not in default and has complied with all of its obligations under the Contract.

Immediate Family means spouse, ex-spouse, defacto spouse, child or step-child, (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, sister, brother, step bother, step sister or first cousin.

Member Referral Reward means a $1,000.00 Prepaid Gift Card.

New Purchaser means a Purchaser who has never previously signed a Contract with, nor made a Reservation to purchase vacant land, a house and land package or a home (as appropriate) from, Allam Homes.

New Purchaser Referral Reward means a $1,000.00 Prepaid Gift Card.

Participating Development means those residential developments (including manufactured housing estates) within Australia nominated by Allam Homes from time to time as being part of the Rewards Program.

Personal Information has the meaning as defined in the Australian Privacy Act 1988 (Cth) and includes any similarly defined personal information in any other jurisdiction.

Prepaid Gift Card means either a prepaid Visa or prepaid Mastercard gift card.

Prior Completed Eligible Contract means a Contract for a purchase price of not less than $100,000.00 which has been completed on or after 1 January 2017 by a Purchaser who has complied with all of its obligations under the Contract.

Privacy Policy means Allam Homes’ privacy policy available online at https://www.allam.com.au/priva....

Purchaser means a natural person or SMSF under a Contract. For the avoidance of doubt, where there is more than one Purchaser, the Purchaser is those parties jointly.

Referral Reward means the New Purchase Referral Reward and the Member Referral Reward.

Repeat Purchase Reward means the reward referred to in clause 3.2.

Reservation means a reservation by a Purchaser for the purchase of vacant land, a house and land package or a home from Allam Homes to be purchased under an Eligible Contract.

Reward means either a Repeat Purchase Reward or Referral Reward as the case may be.

Rewards Member is a person who qualifies under clause 2.

Rewards Program means the Allam Homes Rewards Program.

Rewards Program Commencement Date means 8 April 2024.

Rewards Period means the period of twenty-four months from the Rewards Program Commencement Date.

SMSF means a self-managed superannuation fund as defined under section 17A of the Superannuation Industry (Supervision) Act 1993.

Website means Allam Homes Website available at www.allam.com.au.
